    usa witholding tax

    Im sure this has been loads of times before. I just won 5 k in a 13 way split (dont ask)at the borgata in Atlantic City. When i get the forms they are going to withhold 33%.

    The lady who is running the tournament tells me i cant get it back but that cant be right surly. Im hoping i just need to get an ITN number and claim back at the end of the.

    Thanks in advance for any help. I havnt cashed it yet as there is a massive queue, so will get in the morning/

    Don't you have to fill out a form entering the US in order to avoid tax on decent sized winnings over there!?

      I wasn't really expecting to play poker as were here for break in a nice hotel . So wasn't thinking about filling out any forms .

            you are 100% exempt.. i got an IRA number... ASK at casino cash desk and they will get one for you.. mite take 24hours.. i cashed the main a couple of years ago..guy casing beside me from norway for same amount less 33%...

              I'm left just this morning . I did ask but they hadn't a clue . They actually said it can't be got back . But one of the guys in the split was an accountant and said he was 100% it can be claimed back a year end .

              It's not the total end of the world as there was some cash element in the deal . I paid $1100 in the tax in the end , he mentioned getting a itn number , I have the deduction form .

                Ireland has a tax treaty with the US but The Borgata are applying the New Jersey State laws which requires them to deduct the witholding tax. You need an ITIN Number which I'm sure they asked you for. To get an ITIN you need to apply to the IRS and it can take as much as 6 months to get it.

                All the Nevada Casino's get around this by processing your ITIN application at the cage when you go to cash out. They have figured out a way to get a pre-approval so that they don't have to withold. You get the IRS ITIN a few months later to your home address.

                The same thing happened to me in The Borgata. You can 100% claim it back but it could take over a year. I just let it go as it wasn't worth the hassle (small money) I got my ITIN in the meantime.

                To make matters worse, The Borgata also withold 30% of the value of satellite tickets. Main reason to not play tournaments in NJ if you don't have your ITIN sorted before hand.
